§ 155.99. PENALTY.

  • (A) Misdemeanor.
    (1) Any violation of this chapter shall constitutes a misdemeanor. Any person who is convicted shall be subject to punishment by a fine not exceeding $500 or by imprisonment not exceeding 90 days for each offense, or both, at the discretion of the Court. Each day a violation occurs or continues shall constitute a separate offense.
    (2) Furthermore, any property owners, surveyor, engineer, builder, contractor, agent or other person who commits, participates in, assists in or maintains any violation of this chapter may each be found guilty of a separate offense and may be subject to the penalties provided herein. The cost of prosecution shall also be assessed against the violator.
    (B) Continuing violations. Each act of violation and every day upon which the violation shall occur shall constitute a separate offense or infraction. Abatements shall not be considered as payment or part of a violation's penalty.
